{"id":3216,"date":"2018-05-24T15:57:23","date_gmt":"2018-05-24T15:57:23","guid":{"rendered":"https:\/\/www.setmore.com\/blog\/?p=3216"},"modified":"2025-06-24T14:14:12","modified_gmt":"2025-06-24T08:44:12","slug":"setmore-and-gdpr-compliance","status":"publish","type":"post","link":"https:\/\/www.setmore.com\/blog\/setmore-and-gdpr-compliance\/","title":{"rendered":"Setmore and GDPR Compliance"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">General Data Protection Regulation (GDPR), which is a set of new privacy protections passed by the European Union (EU) <\/span><b>will go into effect on May 25th, 2018.<\/b><span style=\"font-weight: 400;\"> Generally speaking, the purpose of the regulation is to help protect consumers like you with regards to how your personal data is collected and used by the online businesses, products, and services that you browse, sign up for, or otherwise use. This announcement explains how GDPR affects you as a Setmore user.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">In practical terms, what does GDPR do?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">GDPR gives you as a consumer more visibility and control into how tech companies (or any business entity, really) collect and solicit data from you, and what they do with it. For example, in most cases you now can formally request that a company \u201cforget\u201d or delete all personal data about you. If you\u2019re a business owner, then you may also have to fulfill these requests from your customers.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Does GDPR affect Setmore? <\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Setmore is based in the United States but is used by businesses all over the world, including in the UK and the EU. Accordingly, we\u2019ve made some changes to help make Setmore compliant with GDPR that affects all users, regardless of location. <\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Does GDPR affect my business? <\/span><\/h2>\n<p><span style=\"font-weight: 400;\">It might! Especially if you do business in UK or EU, or with citizens of the UK or EU. For obvious reasons, we can\u2019t provide legal advice or direction, but Setmore does offer a number of features and tools that can help you make your business more aligned with spirit of GDPR regulations. <\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/support.setmore.com\/en\/articles\/1784801-setmore-and-gdpr\" target=\"_blank\" rel=\"noopener\"><b>Visit our support article on GDPR to learn more &gt;<\/b><\/a><\/p>\n<h2><span style=\"font-weight: 400;\">The big change: updated Terms of Use and Privacy Policy<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Setmore has updated its Terms of Use and its <a href=\"https:\/\/www.setmore.com\/privacy\">Privacy<\/a> Policy. You don\u2019t have to sign anything, but please note that by continuing to use Setmore on or after May 25, 2018, you consent and agree to the updated Terms of Use and Privacy Policy. A brief summary of changes is below, but you are encouraged to read the full documentation.<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/www.setmore.com\/#privacy-policy\" target=\"_blank\" rel=\"noopener\"><b>Click here to review the updated Setmore Privacy Policy &gt;<\/b><\/a><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">We added a detailed breakdown of the types of personal information we collect from you, and why we collect that information.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">We added a list of third parties with whom we share personal information.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">We added language that clarifies what your rights and choices are as a Setmore user, including how you can request to delete data from the Setmore platform.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">&#8212;<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/www.setmore.com\/#terms-of-use\" target=\"_blank\" rel=\"noopener\"><b>Click here to review the updated Terms of Use &gt;<\/b><\/a><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">We emphasized that agreeing to the <a href=\"https:\/\/www.setmore.com\/terms\">Terms of Use<\/a> also confers an agreement to our Privacy Policy.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">We added a section that speaks to using Setmore with third-party integrations, including payment providers that allow you to take payments within Setmore.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">We added language that clarifies how subscription fees work for our paid services like Setmore Pro.<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">We added language that clarifies the purpose and use of electronic communications that we send you.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">&#8212;<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">A note on obtaining a Data Processing Addendum (DPA)<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If you\u2019re in the EU or otherwise fall under the purview of GDPR and need to obtain a DPA from Setmore, you can sign our DPA at the following link:<\/span><\/p>\n<p style=\"text-align: center;\"><b>Setmore &#8211; EU Data <\/b><b>Processing Addendum (DPA) &gt;<\/b><\/p>\n<p><span style=\"font-weight: 400;\">&#8212;<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">A minor change: rollback of the \u201cRequest for Review\u201d feature<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">As of April 25th, Setmore had launched a new feature that would automatically email your customers after their appointment with you, and request that they post a review to your Booking Page. If you had this feature enabled, we reached out to you personally with an in-app message. If you received no correspondence from us, then the new feature probably didn\u2019t affect your Setmore account or your customers.<\/span><\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/support.setmore.com\/en\/articles\/490944-customer-reviews\" target=\"_blank\" rel=\"noopener\"><b>Click here to learn more about Customer Reviews in Setmore &gt;<\/b><\/a><\/p>\n<p><span style=\"font-weight: 400;\">Due to the complications this creates in meeting GDPR compliance, <\/span><b>we\u2019ve decided to temporarily disable this feature for all Setmore users until future notice.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">We\u2019ll be working on refinements to the Review Request feature to better align it with the spirit of GDPR, and we may launch an updated version of it in the near future.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8212;<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">A note on electronic communications from Setmore<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">In most cases, customers should opt-in to receive electronic communications from a business. However, there are a number of communications which Setmore considers \u201coperationally essential\u201d for the legitimate interest of booking of appointments and ensuring that your customers show up for their appointments.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When you sign up for a Setmore account, you consent to receive electronic communications from us (this is covered in our Terms of Use and Privacy Policy). This typically includes some service-related content that\u2019s designed to educate you about the Setmore platform and what you can do with it. But it also includes operationally essential messages such as appointment confirmation, cancellation, and reminders emails, as well as payment receipts for transactions logged in Setmore. <\/span><\/p>\n<p><b>You may, at any time, opt out of our promotional or educational emails<\/b><span style=\"font-weight: 400;\"> by clicking the \u201cunsubscribe\u201d link in the footer of each email. You can also email us at <\/span><a href=\"mailto:help@setmore.com\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">help@setmore.com<\/span><\/a><span style=\"font-weight: 400;\"> and request to be unsubscribed from these emails.<\/span><\/p>\n<p><b>You may not opt out of operationally essential emails<\/b><span style=\"font-weight: 400;\">, but you may change your account settings to determine which email notifications Setmore sends you. All of the emails that we do send, such as appointment reminders and payment receipts, are considered operationally essential.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, if your customers request to opt out of any electronic communications with your business and are adamant about doing so, or you just want to respect any such requests, you have a few options in your Setmore account. <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><b>Setmore will only send email notifications to customers with a valid email address<\/b><span style=\"font-weight: 400;\"> in their customer profile.
